TERMS OF USE

The SAMHSA Crisis Systems Response Training and Technical Assistance Center (“TTAC”) website (“Site”) provides states, agencies, and individuals with information regarding events, resources, and technical assistance. You may contribute to and use the Site if you agree to abide by these Terms of Use. The Site is provided in partnership with the Altarum Institute (“Altarum,” “our,” “us,” “we”) and the Substance Abuse and Mental Health Services Administration ("SAMHSA ", "us", "we" or "our"). These Terms of Use (“Terms”, “Agreement”) outline your use of the Site. This Agreement sets forth the general terms and conditions of your use of the Site and any of our websites or other online services (collectively, "Website" or "Services"). Please read these Terms carefully. By using our Site, you agree that you have read and understood, and, as a condition of your use of the Site, you agree to be bound by these Terms. You further acknowledge that your use of the Site may be subject to additional terms and conditions, including our Privacy Policy, which is part of this Agreement. If you do not agree to these Terms, you are not permitted to access or use the Site.

LICENSE TO USE OUR SITE

Subject to these Terms and our Privacy Policy, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use our Site. You may download content from our Site only for your personal, non-commercial use unless you obtain Altarum’s prior written permission to do otherwise. Using our Site does not give you ownership of any intellectual property rights in our Site or the content you access.

MODIFICATIONS

We reserve the right to cancel, interrupt, modify, or remove any content. Resources and information provided are subject to the Disclaimers and Limitation of Liability sections that follow.

USER CONTENT

You give us, third-party vendors, and third-party partners permission to use, display, host, share, and back up any personal identifying information, such as your name, address, email address, phone number, professional experience, work history, and certifications and the like (“User Content”) that you may share on the Site.

THIRD-PARTY CONTENT

Users may have the ability to access and/or use content provided by other users, and/or other third parties and links to websites and services maintained by third parties. Altarum cannot guarantee that such content, in the Site or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any files therein. Altarum and SAMHSA disclaim any responsibility or liability related to your access or use of such third-party content.

PHI

“Protected Health Information” means information related to a person’s physical or mental health, such as: Medical history, family history, medical diagnosis, health background, and current health status, sexual behavior, and sexual orientation; Demographic information, including race, ethnicity, marital status, salary, education, political, religious, and trade union information; Information related to the diagnosis and treatment of health conditions, over-the-counter and prescription medications, laboratory test results, and payments for treatment and health insurance information; Other information under applicable law such as HIPAA or an equal State law covering the use or sharing of PHI and as defined by HIPAA. If you choose to upload and or share any PHI to this Site, you do so at your own risk, and it may be re-disclosed and not protected by HIPAA. Altarum and SAMHSA cannot protect the confidentiality of this type of information if uploaded or shared on this Site and are in no way liable or responsible for not doing so.

MODIFYING OUR SITE

We are constantly changing and improving our Site. We may add or remove functions, features, or requirements, and we may suspend or stop a feature altogether. Altarum or SAMHSA may terminate your use of any feature for any reason. None of Altarum and SAMHSA, their contributors, sponsors, and other business partners, and their employees, contractors, and other agents (the “Altarum and SAMHSA Parties”) shall have any liability to you for any such action. You can stop using our Site at any time.

DISCLAIMERS

You acknowledge and agree that any access to or use of the Site is at your own risk. We make no warranty that our services will meet your requirements or be uninterrupted. We are not responsible for the content, data, or actions of third parties, and you release us, our directors, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties. No advice or information, whether oral or written, obtained from us, through us, or from our services creates any warranty not expressly stated in these Terms. Any material downloaded or otherwise obtained through your use of our services is done at your discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. You agree that we have no responsibility or liability for the deletion of, or the failure to store or to transmit, any content or communication maintained by the service. We retain the right to create limits on use and storage at our sole discretion at any time with or without notice.

LIMITATION OF LIABILITY

Altarum and SAMHSA will not be liable to you or any other party for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, regardless of whether we were advised of the possibility of such damage.

REVISION

We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. For any material changes to the Terms, we will take reasonable steps to notify you of such changes. In all cases, your continued use of the Site after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms. If it turns out that a particular provision of these Terms is not enforceable, this will not affect any other terms. If you do not comply with these Terms, and we do not take immediate action, this does not indicate that we relinquish any rights that we may have (such as taking action in the future).

ACCEPTABLE USE POLICY

When using our site, you are not allowed to:

  • Do anything that violates local, state, national, or international law or breaches any of your contractual obligations or fiduciary duties.
  • Reproduce, transfer, sell, resell, or otherwise misuse any content from our Site, unless specifically authorized to do so.
  • Access, tamper with, or use non-public areas of our systems unless specifically authorized to do so.
  • Break or circumvent our authentication or security measures or otherwise test the vulnerability of our systems or networks, unless specifically authorized to do so.
  • Try to reverse-engineer any portion of our Site.
  • Try to interfere with any user, host, or network, for example by sending a virus, overloading, spamming, or mail-bombing.
  • Use our Site to distribute malware.
  • Impersonate or misrepresent your affiliation with any person or entity.
  • Encourage or help anyone do any of the things on this list.

INDEMNIFICATION

You agree to indemnify and hold us and our affiliates, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages, or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website or Services or any willful misconduct on your part.

INTELLECTUAL PROPERTY

Except where expressly stated otherwise, all right, title, and interest in and to the Website and all content, source code, processes, designs, technologies, URLs, domain names, marks, and logos forming any part of the Website (collectively, “Our Content”) are fully vested in us, our licensors, and/or suppliers and protected by copyrights, trademarks, or other proprietary rights and laws. You agree that access and use of Our Content is subject to these Terms. Nothing in your use of this Site grants you the right, title, or interest in or to Our Content except the limited right to use the Site as set forth in these Terms.

GOVERNING LAW AND JURISDICTION

The Site is managed by Altarum, which has its office in the State of Virginia. You agree that any dispute related to these Terms will be governed by the laws of the State of Virginia, excluding its conflicts of law provisions. You further consent to the personal jurisdiction of and exclusive venue in the federal and state courts located in and serving Arlington County, Virginia as the legal forum for any such dispute.

ACCEPTANCE OF THESE TERMS

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Website or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Website and its Services.
